Please read these Terms and Conditions of Use (the "Agreement") carefully. These terms are issued by FASHIONHAIREXPO.COM (the Company). The agreement applies to the entire contents of the FASHIONHAIREXPO.COM's Website under the domain name www.fashionhairexpo.com (the Website ). The terms "you", "your", and "yours" refer to anyone accessing, viewing, browsing, visiting or using the Site. The terms "fashion411expo.com", "we", "us", and "our" refer to Fashion 411 Expo (the company). By using anyFASHIONHAIREXPO.COM you agree to be bound by this Agreement. We reserve the right to change the nature of this relationship at any time and to revise these Terms and Conditions in whole or in part, from time to time at our sole discretion. As such, you should check these Terms and Conditions periodically. Your accessing, viewing, browsing and/or using the Site after we post changes to these Terms and Conditions constitutes your acceptance and agreement to those changes, whether or not you actually reviewed them.If you violate any of the terms of these Terms and Conditions you will have your access canceled and you may be permanently banned from accessing, viewing, browsing and using the Site.
You can determine when this Agreement was last revised by referring to the "LAST UPDATED" legend (at the top right)of this Agreement. You should always check this Agreement prior to using this website FASHIONHAIREXPO.COM. Your continued use of FASHIONHAIREXPO.COM following the posting of changes to this Agreement will mean that you accept those changes.
Entering the Site will constitute your acceptance of these Terms and Conditions. If you do not agree to abide by these terms, please do not enter the Site.
This Site is operated by FASHIONHAIREXPO.COM (the company). We are a company that was started in PA and now our principal place of business is located in Long Island, Roslyn, New York, USA.
We do not discriminate on the basis of age, race, national origin, gender, sexual orientation or religion.
Please review our Privacy and Security Policy, which also governs your visit to the Site. To the extent there is a conflict between the terms of the Privacy and Security Policy and the Terms and Conditions, the Terms and Conditions shall govern.
1. Access to the Website
1.1 By accessing any part of the Website, you shall be deemed to have accepted the Terms in full. If you do not accept these Terms in full, you must leave the Website immediately.
1.2 You are responsible for obtaining access to the Website; and checking for updates of this agreement periodically or prior to any purchase to ensure that you are familiar with the most current version.
1.3 The Company accepts no liability or responsibility for interruptions or delays, or errors, which you might experience on the Website other than as set out in these Terms.
1.4 Access to the Website may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond the Company's control.
1.5 The Company reserves the right to modify or withdraw, temporarily or permanently the Website (or any part of it) with or without notice and shall not be liable to you or any third party for any modification or withdrawal of the Website.
2. OUR RIGHTS
2.1 We reserve the right at any time to:
2:1 A- Refuse a sale or Restrict website access of a customer that violates our terms of service in abusive or harassing nature online, email, via phone. We reserve the right to immediately suspend or terminate your access to the Service, without notice, upon any breach of this Agreement by you, or any criminal activity which is brought to our attention.
2.1.B -Change the terms and conditions of the Agreement;
2.1.C- Change the Website, including eliminating or discontinuing any content on or feature of the Website; or product offered on this website.
2.1.D- Change any item pricing.
2.2. Any changes we make will be effective immediately upon notice, which we may provide by means including, without limitation, posting on the Website or email. Your use of the Website after such notice will be deemed acceptance of the changes. Be sure to review this Agreement periodically to ensure familiarity with the most current version. Upon our request, you agree to sign a non-electronic version of this Agreement.
3.1 You may register with us at any time at zero charge to have access to express purchases and to view special priced marked down items. All buyers of the site will be given an option to register at time of check out in which the buyer may agree or not agree to became a registered member.When and if you register to become a Member, you agree to provide accurate, current and complete information about yourself as prompted by our registration form ("Registration Data"), and to maintain and update your information to keep it accurate, current and complete. You agree that we may rely on your Registration Data as accurate, current and complete. You acknowledge that if your Registration Data is untrue, inaccurate, not current or incomplete in any respect, we reserve the right to terminate this Agreement and your use of the Website.
3.2 When you register, we will require that you provide sufficient information to indicate that you are at least 18 years old. By becoming a Member, you represent and warrant that you are at least 18 years old, which is the minimum required age to become a Member on this website. We cannot guarantee that each Member is at least the required minimum age, nor do we accept responsibility or liability for any content, communication or other use or access of the Website by persons under the age of 18 in violation of these Terms.
3.3 There are NO Membership fees involved in registration on this site.
3.4 Buyers may register an account in their name and only in their name and provide their phone number and address. In the event that buyers do not register in their name and shop on this website using their name, we reserve the right to immediately suspend or terminate your access to the Service, without notice, upon any breach of this Agreement by you, or any criminal activity which is brought to our attention.
3.5 Your Membership to the Website is for your sole, personal use. You may not authorize others to use your Membership, and you may not assign or otherwise transfer your account to any other person or entity.
4. USERNAME AND PASSWORD.
4.1 As part of the registration process, you will be asked to select a username and password. We may refuse to grant any username that impersonates someone else, is or may be illegal, is or may be protected by trademark or other proprietary rights law, is vulgar or otherwise offensive, or may cause confusion, as we determine in our sole discretion. You are responsible for the confidentiality and use of your username and password and agree not to transfer or resell your use of or access to the Website to any third party. If you have reason to believe that your account is no longer secure, you must promptly change your password by updating your account information, after logging on to Website web-Website. YOU ARE SOLELY RESPONSIBLE FOR MAINTAINING THE CONFIDENTIALITY OF YOUR USERNAME AND PASSWORD AND FOR ANY AND ALL ACTIVITIES THAT ARE CONDUCTED THROUGH YOUR ACCOUNT and for restricting access to Your computer to prevent unauthorised access following registration.
5.1 Payments are accepted in the following forms for online and off-Line Payment Options: ONLINE with visa, mastercard, paypal, electronic payment, or western union(online);-AND- OFF-LINE via Fax or Mail with written paper payments, or western union(cash) payment. Or OFF-LINE via phone please note that all phone orders will incur a 15% surcharge.
5.2 Your order's payment will terminate automatically in the event that:
5.2-A. we are unable to process your payment or payment details;
5.2-B your payment is refused; or
5.2-C your payment is not cleared
5.3-A Returns/Exchange: A request must be submitted in writting within reasonable time frame(as noted) from the postal date received. using your account and by emailing a written request with your signature and current date to email@example.com. You must submit your reasons for your item return request with a copy of your purchase details and Transaction id Number or Payment invoice (without this we will be unable to help) (FOR CUSTOM HUMAN HAIR RETURN ORDERS SEE SECTION 5.4-C) . If the return request is for any reason other than receiving a defective item or receiving an item on an error that we cause this refund will not include the cost of shipping which was paid to the designated mail carrier.
5. 4 Cancellation/Refund Policy:
refunds can be granted in full on custom-made human hair orders that
have 1.)already been processed; and 2.) no refunds can be granted in
full on custom-made orders that have already been shipped; or shipped and damaged by customer.
5.4-A All customers will have 30 minutes from time order is placed to cancel their order and receive a full refund.
5.4-B For non-human hair custom orders - If cancellation/refund request is placed anytime after 30 minutes and order processing have already started the customer will be required to pay the processing and restocking fee of 3% of total order. If the order has already shipped and company is able to reverse the shipping direction back to FASHIONHAIREXPO.COM headquarters, the customer will be required to pay shipping fees plus the 3% processing and restocking fees.
5.4-C For human hair custom orders - If cancellation/refund request is placed anytime after 30 minutes and order processing/production have already started, the customer will be assigned a RTN number and the customer will be required to pay 42% of their entire order (This percentage covers the cost of the human hair that was paid by the company to the hair donor and imported into the country to produce the order at 30%, plus the cost of production paid to FASHIONHAIREXPO.COM hair processing workers to produce the order at 12%). If the order has already shipped and company is able to reverse the shipping direction back to FashionHairExpo.com headquaters, the customer will be required to pay shipping fees in addition to the 42% as explained.
5.5 Shipping Conditions
5.5-A Your order will normally be shipped viaStandard United States Postal Service (USPS) or FedEx. If necessary, we reserve the right to use an alternate carrier such asUPS.
Note: Shipping time may sometimes exceed time shown for selected service depending on the distance between seller and buyer such as further away fromour dispatched warehouselocation.
|5.5-B Please remember to verify your your addresses Please confirm your delivery address and email prior to any payment submission. All orders are sent to the address submitted at your payment check-out. Your shipping address should either be submitted the same as on your credit card's billing address or submitted as listed in your profile (if applicable) at the time your order is placed. If you have provided an incorrect shipping address, your order could be delayed or not received at all. We are not responsible for orders shipped to an invalid or incorrect shipping address. PLEASE CHECK AND CONFIRM THAT YOUR SHIPPING ADDRESS HAS BEEN UPDATED WITH YOUR CREDIT CARD COMPANY (IF APPLICABLE) PRIOR TO ANY PAYMENT SUBMISSION. (Please ensure that your spam blockers are not blocking e-mails from our website )|
|5.5-C Lost, or Non-Delivered Mail We are not responsible for packages not received although tracking of packages will be placed on every order sent. However we will investigate (with tracking numbers that are placed on all orders) lost or non-delivered packages. Please note ,non-delivery of a package will not be refundable,and shipping costs are non refundable. Any order that has not been received 30 days after the shipping date is considered a lost order. Lost, stolen, or damaged orders will be replaced ONLY if the order was insured. We consider an order to have been received by the buyer's when the FedEx or UPS status for the package is "Delivered".|
5.5-D International Shipping
IMPORTANT DISCLAIMER FOR INTERNATIONAL CUSTOMERS:
For the most part, our international packages arrive safe and sound, though sometimes they can be delayed for six weeks or more depending on the destination country’s customs regulations. Please contact your local customs, to see shipping methods what will work best for your particular situation (depending on whether you are a business or buying more than a certain amount, one shipping carrier might be better than the other). Please read the following disclaimers carefully.
- No guaranteed international deliveries: Unfortunately, delivery times to international destinations are NOT guaranteed due to the unpredictability of time spent in customs. Customs might delay delivery for six weeks or more depending on your country’s regulations. Please contact your local customs office for more information.
- Customs fees and taxes: All international duties, taxes, brokerage fees, and any other fees associated with customs clearance or international imports are your responsibility. Please contact your local customs office and FedEx or USPS for an estimate of any additional fees.
- Tracking: Some countries using certain shipping methods listed below are not trackable. You are solely responsible for taking the risk of sending any products without tracking.
- If you submit an order within untrackable shipping area option via USPS, there is no way to know where your package is during transit. If the package was lost, and you do not receive it, you must wait until USPS deems the package lost before you can file a claim. Please contact USPS to find out how long you have to wait until a package is officially lost (typically at least 30 days).
- By selecting an untrackable shipping delivery area, you agree that if the package is lost, damaged, or stolen in transit, you will not hold Fashionhairexpo.com responsible for the loss. We will not re-ship the item for free, we will not provide a refund, and we will not provide a credit. Please be advised that in unfortunate situations as not receiving a package in an untrackable delivery area the ‘Shipping Company/USPS or FedEx’ must be held liable for any lost and expected to compensate the buyer.
- If your package is lost, damaged, or stolen in transit, we recommend for the buyer to submit a complaint to the Shipper/USPS or Fedex. From there the Shipper will give you a time period to wait (estimated 12 weeks) for the United States Postal Service or FedEx to process your claim. The shipper must be held liable for any lost and is expected to compensate the buyer. Please contact FedEx and USPS for information on what they will cover and how long a package must be delayed before they deem it lost.

6. ONLINE CONDUCT
6.1 As a User/Member, you agree that:
(A):You will use the website in a manner consistent with any and all applicable laws and regulations. We reserves the right, to reject any harassing, fraudulent or criminal activities that does not comply with the following prohibitions:
(B):You will not impersonate any person or entity.
(C): You will not "stalk" any member, company representative or employees as measures to resolve an issue in connection with this website. All issues or complaints must be directed to the appropriate complaint contacts as listed below in article number 14.
(D): You will not harass or otherwise falsely accuse "the company" or any customer service member, company representative or employees as measures to resolve an issue in connection with this website. (G): You will not express or imply that any statements you make are endorsed by us, without our specific prior written consent;
(H) You will not harvest or collect personal information about other members or our staff whether or not for commercial purposes, without their express consent;
(I) You will not use any robot, spider, site search/retrieval application, or other manual or automatic device or process to retrieve, index, "data mine", or in any way reproduce or circumvent the navigational structure or presentation of the Website or its contents;
(J) You will not post, distribute or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior consent of the owner of such proprietary rights;
(K) You will not remove any copyright, trademark or other proprietary rights notices contained in the Website;
(L) You will not interfere with or disrupt the Website, the servers or networks connected to the Website;
(M) You will not post, or send email or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
6.2 We do not exclude any liability for death or personal injury due to our negligence.
7. INDEMNITY BY MEMBER
7.1 You agree to indemnify and hold harmless the Company against all claims, expenses and costs (including legal costs) incurred or suffered by us as a result of or in connection with (i) your breach of this Agreement; (ii) any allegation that any materials that you submit to us or transmit to the Website infringe or otherwise violate the copyright, trademark, trade secret or other intellectual property or other rights of any third party; and/or (iii) your activities in connection with the Website unless as a result of your compliance with our requirements.
8. ONLINE CONTENT
8.1 The Website may contain links to other websites or resources operated by parties other than the Company . The Company's inclusion of hyperlinks to such websites does not imply any endorsement of the material on such websites or any association with their operators . You acknowledge and agree that we shall not be held responsible for the legality, accuracy or inappropriate nature of any content, advertising, products, services or information located on or through any other websites or for the operation or policies of any such websites, nor for any loss or damages caused or alleged to have been caused by the use of or reliance on any such Websites or such content or other information.

12.3 For human hair orders, the company will not be responsible for any damage of the hair caused such treating the hair with non-recommended practices.
12.4 For human hair coloring, please note that we do NOT recommend for customers to color their purchased hair extensions, that is, if they have not purchased "Natural Color". Note, we make Natural Color available within the color portion of hair colors when ordering and it can be found under the name [[[['Natural Color- ideal for do-it-yourself coloring]]]].' But if customers do not order Natural Color hair then it should NEVER be dyed. We can not be held liable for those that mis-use, or damage their hair purchase and do not follow our recommendations.
12.5 The company will not be responsible for anything damaged by customers a result of reading, viewing or listening to any material, or any part of it, on the Website.
12.6 The Company is not liable or responsible for any inaccuracies, errors (including typographical errors) or omissions, or for the results obtained from the use of the Website or its content. Website PROVIDES THE SERVICE AND THE SITE ON AN "AS IS" BASIS AND GRANTS NO WARRANTIES OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY, IN ANY COMMUNICATION WITH Website OR ITS REPRESENTATIVES, OR OTHERWISE WITH RESPECT TO THE SERVICE OR THE SITE. 13.4 We shall have no liability to you for any failure to provide the Services to you if caused by any event or circumstances beyond our reasonable control including, without limitation, strikes, lockouts and other industrial disputes, breakdown or systems or network access, flood, fire, explosion or accident.
13.5 Although we have limited our liability in this Clause 12 nothing in these Terms limits our liability for death or personal injury caused by our negligence and nothing affects your legal rights.
14.1 To resolve a complaint regarding a purchase,the Website or any concern regarding FashionHairExpo.com either submit a SUPPORT TICKET (via our website within your account) -OR- send us an EMAIL at: on our CONTACT US page. Please allow 24 hours (from the time that you submit your complaint) to receive a response back to you. We require 24 hours to investigate your complaint and develop a solution to your problem. We identify many cases of online theft by those that do not allow us enough time of at-least 24 hours if they demonstrate an action of quickly filing a dispute or complaint with any 3rd party company such as your Bank, Credit Card company or Paypal, in attempts to receive the product and return of funds. For this reason, we reserve the right to restrict access to our website and the sales of those that violate our terms of service. If you do not agree to these terms please do not shop on our website.
15.1 If any part of this Agreement is unenforceable including any provision in which we exclude our liability to you the enforceability of any other part of these conditions will not be affected.
17. GENERAL PROVISIONS
17.1 The Company may assign the Agreement or subcontract any or all of its rights and obligations under the Agreement. You may not assign, transfer, charge or deal in any other manner with the Agreement or any of its rights under it without the prior written consent of Website .
17.2 The Agreement shall terminate immediately and without notice if you breach any of the Terms, subject to the survival of all rights and reservations of Website.
17.3 A person who is not a party to this agreement has no right under Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement but this does not affect any right or remedy of a third party which exists or is available apart from that Act
17.4 The contract between us shall be governed and interpreted in accordance with the United States, Long Island New York and the Nassau County Courts system shall have jurisdiction to resolve any disputes between us.
17.6 Unless otherwise explicitly stated, the Terms will survive termination of your Membership to the Service.
17.7 If any part of these terms and conditions are unenforceable including any provision in which we exclude our liability to you the enforceability of any other part of these conditions will not be affected.
17.8 The user/member certifies that the user/member has read and agrees to be bound by these Website user/member Terms and Conditions
18. GENERAL CUSTOMER SERVICE
18.1 To contact our customer service representative, we require customers and visitors to create a profile and submit a support ticket within their profile for fast turnaround answers. Option 2. Emailing customer service. Option 3. Calling customer service.
18.2 By contacting customer service on the Website you agree that under no circumstance will the Company or its agents,representatives or employees be held liable or responsible for recommending any products on this website. The sole responsibility of our customer service is to provide information about products. Recommendation of a particular products in regards to matching a customers style type, hair type or anything that requires an in-person evaluation is prohibited (also a violation on the part of the customer service representative). In matters of personal style or hair style or hair extensions purchases, we recommend that customers ONLY make purchase based on the recommendation or direct instructions of their stylist of hair stylist.
18.3 The Company will not be liable or responsible for any damage or misuse of a product that the customer has or has not been educated in prior to their purchase. It is the responsibility of the customer to receive education on the product/s that they buy prior their purchase. Customer service representatives are required to recommend that those purchasing hair extensions and hair extensions products to be instructed directly by their hair stylist on how and what to purchase.
18.4 If any customer contacts a customer service representative in regards to an error made by the buyer, the Company is not liable or responsible for any inaccuracies, errors placed by the customer during orders.
